RESERVATIONS:

Demand for flights/accommodation can get very high and can lead to a shortage of seats/rooms. All bookings will be confirmed, but on occasions, changes may be necessary. Airlines/hotels/lodges/camps where specifically named are given as an indication of the category, and seats/rooms may be reserved at similar airlines/hotels/lodges/camps. We undertake to advise you of any changes known to the Supplier prior to departure, but the possibility of change without notice must be accepted when booking.

Single rooms are available at a supplementary cost, as are airport transfers.

Safari minibuses, saloon cars, four wheel drive vehicles or coaches will be provided according to the route and number of clients. The right is reserved to employ the services of subcontractors. English speaking chauffeur/guides are provided, or should you require those who speak other languages they will be provided subject to notification.

Occasional mechanical problems, changes of airlines/hotels/lodges/camps or adverse road conditions may in turn result in a change of routing or game viewing without prior notice being given. We reserve the right therefore to offer substitutes of equal value or to cancel the operation of any tour. In practice very few itineraries are affected but a little flexibility, on your part, will ensure that your tour is unique and rewarding.

PAYMENTS:  

Payments may be made by:

•  cash

•  cheque made out to ‘Exotic Expeditions Limited'

•  credit card payments from VISA cards. American Express cards are not accepted. For those not in Nairobi credit card details may be emailed with accompanying personal verification documents.

•  bank transfer to Exotic Expeditions Limited (Kshs, USD or Euro accounts). Email us for bank details.

All reservations must be paid for BEFORE the safari / flight / cruise. A 65% deposit is mandatory to secure the booking, the remaining 35% to be paid at least 7 days before the date of travel (especially cheques, credit cards and bank transfers to allow for clearance). A voucher to facility entry to the accommodation / flight / cruise ship / train or other vehicle will be issued on COMPLETION of payment.

Credit facility clients will receive an invoice and issue payments as per separate agreement with Exotic Expeditions Limited. Credit facilities are offered for flights only and are subject to approval.

Note: All BANK CHARGES are payable direct by the Client.

CREDIT LIMIT:

This applies to Credit facility clients only and the credit limit is set as per separate agreement with Exotic Expeditions Limited. 

CANCELLATION POLICY:

Should Exotic Expeditions Limited have already paid for the tickets / reservations and the airline / hotels / transport providers do not issue a refund, the Client will not be issued a refund by Exotic Expeditions Limited.

For reservations made but not yet paid for, the following cancellation charges are applicable. Should you need to cancel tickets / reservations you must notify Exotic Expeditions Limited immediately in writing.

Cancellation fee from 90-60 days - 25%

Cancellation fee from 59-30 days - 50%

Cancellation fee from 29-15 days - 75%

Cancellation fee from 14-00 days - 100%

LIABILITY:

a)  Exotic Expeditions Limited is insured against legal liabilities arising from injuries, which might be received by passengers while on flights or in vehicles that may be hired. Clients are however strongly advised to take out own insurance against the risks inherent in traveling. Please remember that Exotic Expeditions Limited does not undertake to provide rapid evacuation and medical facilities at its expense hence our strong recommendation that Clients arranges own insurance to cover such eventualities.

b) Exotic Expeditions Limited and its agents act only as agents of the Client in all matters relating to reservations.

c) Exotic Expeditions Limited's obligations apply to those services which they agree to provide on the Client's behalf. Exotic Expeditions Limited cannot be held liable for any third party arrangements which the Client arranges on his own. For example Exotic Expeditions Limited cannot be held liable if the Client misses their flight because they fail to arrive at the airport at the agreed time.

d) Exotic Expeditions Limited's liability to passengers carried in its own vehicles is governed by the laws of the respective country and all claims are subject to the jurisdiction of the courts of the respective country and all claims are subject to jurisdiction of the courts of the respective country in which services are provided.

e) Exotic Expeditions Limited reserves the right to employ sub-contractors to carry out all or part of the services agreed to be supplied and in the event of the exercise of such right the terms relating to Exotic Expeditions Limited's liability shall apply.

f) Whilst every care is taken, Exotic Expeditions Limited cannot be held responsible for the loss or damage of baggage. It is therefore advisable to affect separate baggage insurance.

g) Law & Jurisdiction:-

•  This Agreement shall be construed and shall take effect in accordance with Kenyan law.

•  Any dispute, difference or question which may arise at any time hereinafter between the parties herein touching on the true construction of this agreement or the rights and liabilities of the parties hereto shall unless otherwise herein expressly provided be referred to the decision of a single arbitrator in accordance with and subject to the provisions of the Arbitration Act or any statutory modification or re-enactment thereof for the time being in force. The said arbitrator shall be mutually agreed upon between the parties failing which shall be appointed by the Chairman for the time being of the Chartered Institute of Arbitrators at the request of either party.

GENERAL:

Prices are based on fares/rates and other costs prevailing at the time of Client requests, and are subject to change without notice if fares or rates subsequently vary. All prices and availability are subject to change.
